Changes to Terms of Service

PULA Technologies Ltd reserves the right to modify this Terms of Service and will notify you through one or more of the following means; the website at www.avatarconnection.com, through the Avatar Connection Viewer login page or after log-in to your Account, by your e-mail address in our records, or by written mail communication to the address on record for your Account.

Eligibility and Registration of service

By using Avatar Connection, you agree to these Terms of Service. If you do not so agree, you should decline this agreement, in which case you are prohibited from accessing or using Avatar Connection.

Avatar Connection is in “development mode” and during this mode the grid (virtual world) is strictly rated over 18. By accepting this Agreement in connection with an account on Avatar Connection, you represent that you are at least 18 years of age, or the legal age of majority where you reside if that jurisdiction has an older age of majority, and you have the legal authority to enter into this Agreement. Once a system for age verification can be assured, areas of Avatar Connection Grid will become PG and an amendment to this agreement will be made at that time to reflect the change in terms of service. (You will be notified under the section Changes to Terms of Service). However even during development mode all content on the Avatar Connection website and Avatar Connection grid mainland must be suitable for PG rating.

You agree to abide and respect any age restrictions or conditions of individual regions.

You may not use or register to use Avatar Connection Grid (i) for the duration of any suspension that has been issued to you by PULA Technologies Ltd ; (ii) at any time you have been terminated from the Service by PULA Technologies Ltd; (iii) at any time you are a person barred from receiving the Services under applicable law; or(iiii) if you are a person registered on a Child Protection Register.

You agree to provide accurate, current and complete information about yourself as prompted by the registration form and to use the account management tools provided to keep your Registration Data accurate, current and complete.

You must establish an Account on Avatar Connection to use the Service, except for those portions of the Websites which PULA Technologies Ltd allows users to access without registration. You may not transfer or assign your Account and its contractual rights, licenses and obligations, to any third party without the prior written consent of PULA Technologies Ltd .

When registering your Avatar/User name you must use a name that is not (i)offensive, a name that PULA Technologies Ltd deem in its sole discretion to be vulgar or hateful. (ii) misleading, a name of another person/avatar/character that could cause deception or confusion, a name that could mislead other users/members to believe you to be an admin/employee of Avatar Connection or PULA Technologies Ltd (iii) infringing, a name that could be in violation of any trademark right, copyright or other proprietary right. PULA Technologies Ltd reserves the right to delete or change any Avatar Connection avatar/user name as they solely deem to be unsuitable.

Although on registration you are not required to give data of your real life/legal/official name, address, date of birth etc you agreed that if upon request by PULA Technologies Ltd you will provide the details requested and confirmation of those details and you understand that failure to compile with a request for further details may result in suspension/cancellation of your Avatar Connection account. Any requested data will be covered by our Privacy Statement.

Upon opening an Avatar Connection account you must select a password. It is your responsibility for maintaining the confidentiality of your password and you will be held responsible for any harm or breech of these Terms of Service resulting from your disclosure of your password. You should not disclose your password to any other person, response to any email or online request for your password other than in connection with the log-in/log-on of the Avatar Connection service. PULA Technologies Ltd or Avatar Connection will never send mail requesting your password.

You may establish an Account with Registration Data provided to PULA Technologies Ltd by a third party who provides a gateway to our Service through the use of an API, in which case you may have a separate, additional account relationship with such third party. This relationship in no way modifies, lessens or alters your obligations under this Terms of Service. Access to Avatar Connection through third parties may be available or discontinued at the discretion of PULA Technologies Ltd. You acknowledge that PULA Technologies Ltd is not liable for the acts or omissions of such third parties, which are not the partner or representative of PULA Technologies Ltd or endorsed or controlled by PULA Technologies Ltd.

Service

Definition of the service provided by PULA Technologies Ltd in Avatar Connection, is a multi-user social environment. By using Avatar Connection you understand that PULA Technologies Ltd is a service provider that enables its users to interact online, display and communicate information and content chosen by those users. PULA Technologies Ltd does not control, endorse or screen the content or the communications between users or users' interactions with each other. PULA Technologies Ltd is not liable for its users' actions, and you release PULA Technologies Ltd from any claims relating to users or their content.

To access our server you will need your own internet connection access. PULA Technologies Ltd does not provide internet access, and you are responsible for all fees associated with your internet connection.

PULA Technologies Ltd in Avatar Connection provides a service in a development mode on an "as is" basis, without express or implied warranties, and all services, content, downloads, avatars and Virtual Land have no guarantee or warranty of any compensable value.

PULA Technologies Ltd has the right to change and/or eliminate any aspect(s), features or functionality of the Service as it sees fit at any time without notice, and PULA Technologies Ltd makes no commitment, express or implied, to maintain or continue any aspect of the Service. You acknowledge that your use of the Service is subject to this risk and that you knowingly assume it and make your decisions to participate in the Service, contribute content and spend your money accordingly.

You agree that PULA Technologies Ltd has and may exercise the right in its sole discretion to pre-screen, refuse, or delete any content or services from the service or disable any user's access to the service without notice or liability to you or any other party, including upon our belief that such user's conduct, content, services, or use of the service is potentially illegal, threatening, or otherwise harmful to any user or other person or in violation of our Terms of Service.

All data on Avatar Connection servers are subjected to deletion or alteration. You acknowledge that the items (data) you create using the service and sits on our servers have no guarantee or value, cash or otherwise and PULA Technologies Ltd has the right, but not the obligation, to remove or alter any data in whole or part as they deem solely fit and in the interest of Avatar Connection.

You may cancel your account at any time on the website via your profile page (edit profile>delete account) However, there are no refunds for cancellation. Upon your election to cancel, your web account will be cancelled immediately, but if you have paid for a service (virtual Land) in advance you will retain access to use via the virtual world (grid) for the remaining time. Although an account may have been terminated/cancelled the name of that account (the avatar name) will remain in the virtual world (grid) database as it will be connected to assets within the database.

Avatar Connection is owned and run by PULA Technologies Ltd, therefore any dispute with Avatar Connection will be dealt with by PULA Technologies Ltd. You and PULA Technologies Ltd agree to resolve any claim or controversy at law or in equity that arises or related to this agreement (Terms of Service) in accordance with the below:

Governing Law. This Agreement and the relationship between you and PULA Technologies Ltd shall be governed in all respects by the laws of the United Kingdom, without regard to conflict of law principles or the United Nations Convention on the International Sale of Goods.

Virtual Land

Avatar Connection is free for anyone to play, but does offer a paid product commonly know as “Virtual Land”. You understand that virtual land is hosted space on the Avatar Connection Servers and not actual land. To have your own hosted space on Avatar Connection servers (virtual land) you must enter in to a Land subscription agreement through paypal. Land Subscription is an agreed amount per calender month for a agreed size of virtual land paid monthly (calendar month) through Paypal subscription method of payment. The subscription is paid a month in advance. (ie pay on the 20th of the month and you have use of the virtual land until the 20th of the following month.) A land subscription is an ongoing agreement. Land subscriptions can be cancelled at any time, however it is your responsibility to cancel the land subscription through your paypal account. For land subscriptions that are cancelled by yourself, there are no refunds for remaining time and you will retain access to the virtual for the full time it has been paid for. If land subscriptions are cancelled due to termination for breech of the Term of service, there is no refundable or compensable value to the land subscription.

Content created or uploaded my yourself

You retain copyright and other intellectual property rights of content you create, upload, submit or input to Avatar Connection grid or website to the extent you have such rights under applicable law. For content that is covered by this copyright and intellectual property rights, you specifically give us (PULA Technologies Ltd) the following permission:- you grant us (PULA Technologies Ltd) a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or create, in connection with Avatar Connection("IP License"). This License ends when you delete your IP content or your account, unless has been used in PULA Technologies Ltd, Avatar Connection Grid or website advertising/official posting or your content prior has been distributed through Avatar Connection by yourself then the member that has received the content retains the right to use within Avatar Connection under the permissions or license you set out for distribution.

You agree not to upload, publish, create or input any content that infringes copyright, intellectual property rights or licences.

You agree that even though you may retain certain copyright or other intellectual property rights with respect to content you create while using the Avatar Connection service, you do not own any data PULA Technologies Ltd stores on their servers and there is no compensable value for lost or deleted data. It is your responsibility to back up and store back ups of any of your content. This does not effect your copyrights or other intellectual property rights.

Content obtained in Avatar Connection virtual world grid (in world content)

Avatar Connection virtual world grid is an environment in which users can create, share and distribute content between other users and can specify permissions on that content. You agree to respect and abide by any permissions or licences set by the creator/IP owner of the content and agree not to export the content outside of Avatar Connection unless you have written consent from the creator/IP owner.

PULA Technologies Ltd will respond to allegations of copyright or Intellectual property violations in respect to the guide lines set out in the Digital Millennium Copyright Act. To notify PULA Technologies Ltd that your copyrights or Intellectual property rights may of been infringed please use our Report IP/copyright infringement page.

Please note you maybe liable for damages if you falsely claim that an item is infringing your copyrights.

Safety and Standards (S.A.S) guidelines

Your safety and enjoyment while using our Avatar Connection service is import to us at PULA Technologies Ltd. While we do our best to keep you safe and happy, we can not guarantee it. As part of this terms of service you agree to read and abide by our Safety and Standards guidelines.

  • You will not collect users' data, content, information, or otherwise access Avatar Connection using automated means (such as harvesting bots, robots, spiders, copybots or scrapers).

  • You will not send, post, chat or IM excessive commercial communications (eg spam)

  • You will not bully, intimidate, harass, stalk, any user or use offensive, vulgar, coarse language.

  • You will not do anything that could disable, overburden, or impair the proper and normal working of Avatar Connection grid and website.

  • You will not post content that is; hateful, misleading, threatening, unlawful, malicious, incites violence, pornographic, or contains nudity of a sexual nature or graphic or gratuitous violence.

  • You will not post or upload real life images or depictions of a sexual nature involving or appearing to involve children or minors(under 18 yrs ), this includes virtual representations of sexual acts with avatars representing children or minors(under 18yrs). Sexual age play (an avatar representing its self as a child or child like character in a sexual or lewd manner or style) is strictly against our terms of service, and any persons or groups found promoting, participating or providing such activities will be subject to (one or all) actions of suspension, investigation and termination.

  • You will not post private or personal correspondents, this includes emails, private messages (Pms), instant messages (Ims), chat logs (full or part) without all parties consent.

  • You will not remotely monitor conversations, post conversation logs, or share conversation logs.

  • You will not disclose personal information about a fellow member that they have not put in the public domain themselves. All members are entitled to a reasonable level of privacy.

  • You will not engage in unlawful multi-level marketing, such as a pyramid scheme.

  • You will not misrepresent yourself as someone else or entity you are not or otherwise misrepresent your affiliation with a person, entity or company. This includes, but not limited to, misleading other Avatar Connection members/users that you have an affiliation with Avatar Connection, PULA Technologies Ltd or any of our employees and have authority to speak on their behalf. The names of official admins, employees, moderator, helpers etc can be found in the Avatar Connection Notices and updates forums.
